S68—Register of Interests

(1) The chief executive officer must maintain a Register of Interests and must cause to be entered in the Register all information furnished pursuant to this Division and Schedule 3. Pursuant to Section 70(a1) of the Local Government Act 1999 a summary of the register must be published on the website. The current Section 70(a1) Register can be found here.

S116—Register of Interests

(1) The chief executive officer must maintain a Register of Interests and must cause to be entered in the Register all information furnished pursuant to this Division (including by the chief executive officer). Register can be found here.

A person is entitled to inspect the Registers of Interest on application to the Chief Executive Officer.
S79—Register of EM allowances and benefits

(1) The chief executive officer of a council must ensure that a record (the Register of Allowances and Benefits) is kept in which is entered, in accordance with principles (if any) prescribed by the regulations, in respect of each member of the council—

(a) the annual allowance payable to the member; and

(b) details of any expenses reimbursed by the council under section 77(1)(b); and

(c) details of other benefits paid or payable to, or provided for the benefit of, the member by the council.

S74(5) and 75A(4) —Elected Members Register of Conflict of Interest

If a member of a Council discloses a material conflict of interest in a matter to be discussed at a meeting of the Council, the following details must be records in the minutes of the meeting and on Council’s Website:

  1. the member’s name;
  2. the nature of the interest, as described by the member;
  3. if the member took part in the meeting, or was in the Chamber during the meeting, (under an approval under subsection (3), the fact that the member took part in the meeting, or was in the chamber during the meeting.

If a member of a Council discloses an actual or perceived conflict of interest in a matter to be discussed at a meeting of the Council, the following details must be recorded in the minutes of the meeting and Council’s website:

  1. the Member’s name;
  2. the nature of the interest, as described by the member;
  3. the manner in which the member dealt with the actual or perceived conflict of interest;
  4. if the member voted on the matter, the manner in which he or she voted;
  5. the manner in which the majority of persons who were entitled to vote at the meeting voted on the matter.

S105—Register of remuneration, salaries and benefits
(1) The chief executive officer of a council must ensure that a record (the Register of Salaries) is kept in which is entered, in accordance with principles (if any) prescribed by the regulations—

(a) the title of each position held by an employee of the council; and

(b) in relation to those positions held by employees who are paid according to salary scales set out in an award or  industrial   agreement—

(i) the classifications of the employees who hold those positions; and

(ii) the salary scales applicable to each classification (indicating in relation to each scale the number of employees who  are paid according to that scale); and

(iii) details of other allowances or benefits paid or payable to, or provided for the benefit of, any of those employees as part of a salary package; and

(c) in relation to each position held by an employee who is not paid according to a salary scale set out in an award or industrial agreement referred to above—

(i) the salary payable to the employee who holds that position; and

(ii) details of other allowances and benefits paid or payable to, or provided for the benefit of, the employee as part of a remuneration package.

S196—Management plans 

(1) A council must prepare and adopt a management plan or management plans for its community land if—

(a) the land falls within the ambit of section 194(1)(b) or (c); or

(b) the land is, or is to be, occupied under a lease or licence; or

(c) the land has been, or is to be, specifically modified or adapted for the benefit or enjoyment of the community.

S207—Register of Community Land 

(1) A council must keep a register of all community land in its area.

(2) The register—

(a) must contain the information required by the regulations; and

(b) must contain copies of current management plans; and

(c) may consist (if the council so decides) of a computer record of the relevant information.

(3) The register must be available for inspection (without charge) by the public at the principal office of the council during ordinary office hours.

(4) A person is entitled, on payment of a fee fixed by the council, to an extract from the register.

S231—Register of Public Roads

(1) A council must keep a register of public roads in its area.

(2) The register—

(a) must include the information required by regulation; and

(b) may consist (if the council so decides) of a computer record of the relevant information.

(3) The register must be available for public inspection (without charge) at the principal office of the council during ordinary office hours.

(4) A person is entitled, on payment of a fee fixed by the council, to an extract from the register.

S260—Register of authorised persons
(1) A council may, by instrument in writing, appoint a person (other than a member of the council) as an authorised person.

Gifts and Benefits Register

Elected Member Gifts and Benefits Register

Legislation introducing a Code of Conduct for Council Members commenced on 1 September 2013.

The Code has been made by the Local Government (General) Variation Regulation 2013 and gazetted in the Government Gazette on 22 August 2013.

For the purposes of 3.10 of the Code of Conduct, the threshold amount governing when a gift or benefit must be registered has been gazetted at $100.00.

Employee Gifts and Benefits Register

Legislation introducing a Code of Conduct for Council Employees commenced on 13 February 2014. It was amended in 2018, coming into operation on 2 April 2018.

The Code of Conduct says that if an employee of a council receives a gift or benefit of an amount greater than the amount determined by the Minister, by notice in the Gazette, then the gift or benefit must be entered onto the Gifts and Benefits Register.

The threshold amount governing when a gift or benefit must be registered has been gazetted at $50.00.
